Sponsorship Appeals

A sponsorship appeal is filed when an application for a permanent residence is refused. This is sent to the Immigration Appeal Division (IAD) to demonstrate how an error was made. An individual may appeal to the IAD if they are a permanent resident or Canadian citizen who applied to sponsor a family member but was refused.

A sponsorship appeal must be filed within 30 days of the refusal of the sponsorship application. Once the application is sent to the IAD, a leave is obtained. The individual can then attend a hearing before the IAD to further expand on the appeal. If this appeal is approved, the application will continue and if the appeal is refused the applicant may process an appeal at the federal court.
