Humanitarian and Compassionate Applications (H&C’s) are a pathway that allows applicants who do not have legal status in Canada to apply for permanent residence in the country.
Individuals who do not have legal status are eligible for H&C’s if:
- They have family ties to Canadian permanent residents/Canadian citizens
- They’re employed in Canada without a valid Canadian work permit
- They’re studying in Canada without a valid Study Permit
- They’re doing volunteer work in Canada
- They possess savings and property in Canada
If the Humanitarian and Compassionate (H&C) application is approved, the individual must go through the necessary immigration medical exams and police clearance to obtain the Canadian Permanent Residence Card (PR Card). However, if the H&C application is rejected, an appeal must be sent within 15 days to the Federal Court of Canada.
